By accessing and using the Native Seed Co website (nativeseedco.org), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or purchase our products.
Native Seed Co sells Australian native seeds and related gardening products. All products are subject to availability. We reserve the right to discontinue any product at any time without notice.
Seed Germination: While we strive to provide high-quality seeds with good germination rates, we cannot guarantee germination success as this depends on many factors outside our control, including soil conditions, climate, watering practices, and care provided by the purchaser.
All orders are subject to acceptance and availability. We reserve the right to refuse any order. Payment must be made in full at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout.
All prices are displayed in Australian Dollars (AUD) and include GST where applicable.
We ship Australia-wide. Delivery times are estimates only and may vary depending on your location and external factors such as courier delays. Free shipping is available on orders over $100.
Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier.
Certain plant species sold by Native Seed Co are classified as declared weeds, pest plants, or restricted organisms in specific Australian states and territories under their respective biosecurity legislation. We are legally prohibited from selling or shipping these species to states where they are restricted.
Our obligations: We enforce state-based shipping restrictions on affected products through notices on product pages, validation in our shopping cart, and order review before dispatch.
Your obligations: By placing an order, you confirm that you have checked and understand the biosecurity restrictions that apply to your state or territory. You must provide an accurate shipping address. We accept no liability for penalties or consequences arising from restricted species being introduced to areas where they are prohibited, particularly where the buyer has provided an incorrect shipping address.

Key legislation includes the Landscape South Australia Act 2019, Weed Management Act 1999 (TAS), Catchment and Land Protection Act 1994 (VIC), and the Biosecurity and Agriculture Management Act 2007 (WA).
All sales are final. Due to the nature of seeds and the inability to verify their handling once dispatched, we do not offer refunds or accept returns for change of mind, dissatisfaction with purchase, or any reason other than those required by Australian Consumer Law.
Under Australian Consumer Law, you may be entitled to a refund, repair, or replacement if goods are faulty, not as described, or fail to meet a consumer guarantee. If you believe your order qualifies for a remedy under consumer law, please contact us with details of the issue.
We may offer the ability to leave reviews or feedback on our products. By submitting a review, you agree that your content is accurate, based on your genuine experience, and does not contain offensive or inappropriate material. We reserve the right to remove or edit reviews at our discretion.
