Native Seed Co takes Australian biosecurity seriously. We comply with all state and territory regulations regarding the sale and distribution of plant seeds. Some Australian native species, while valued in their home range, are declared weeds or restricted organisms in other states. We enforce these restrictions to protect Australia's diverse ecosystems.
Each Australian state and territory has its own biosecurity legislation designed to protect local ecosystems, agriculture, and biodiversity. Some native species that thrive in one part of Australia can become invasive weeds when introduced to another region where they have no natural predators or competitors.
For example, Bacon and Eggs (Gastrolobium capitatum) is native to Western Australia but contains fluoroacetate, making it toxic to livestock. It is restricted outside its native range in South Australia, Victoria, New South Wales, and Tasmania under stock protection legislation.
Similarly, Coastal Tea Tree (Leptospermum laevigatum) is a valued species in its home range but has become an environmental weed in South Australia and Victoria, where it forms dense stands that displace native vegetation in coastal areas.
The following products have shipping restrictions due to state biosecurity declarations. We cannot sell or ship these products to the listed states.

Some of our bundled collections contain restricted species. If a bundle contains even one restricted species for your state, the entire bundle cannot be shipped to that state.

The following legislation governs the sale and distribution of plant material across Australian states and territories:
South Australia
Landscape South Australia Act 2019 — Declared plants under this Act cannot be sold, traded, or distributed within SA.
Tasmania
Weed Management Act 1999 — Regulates declared weeds that cannot be imported into or distributed within Tasmania.
Victoria
Catchment and Land Protection Act 1994 (CaLP Act) — Classifies noxious weeds and regulates their trade and movement.
Western Australia
Biosecurity and Agriculture Management Act 2007 — Governs quarantine and biosecurity for plant material entering WA.
New South Wales
Biosecurity Act 2015 — Regulates biosecurity risks including invasive plant species.
Queensland
Biosecurity Act 2014 — Establishes a framework for managing biosecurity risks and restricted matter.
Northern Territory
Weeds Management Act 2001 — Manages the spread and impact of declared weeds in the NT.
Australian Capital Territory
Pest Plants and Animals Act 2005 — Regulates pest plants that cannot be sold or distributed in the ACT.
While we make every effort to keep our restriction data current and accurate, biosecurity regulations can change. It is the buyer's responsibility to verify that the plants they purchase are legal to grow in their state or territory. If you are unsure about any restrictions, we recommend contacting your local biosecurity authority before placing an order.
Native Seed Co accepts no liability for any penalties or consequences arising from the introduction of restricted plant species into areas where they are prohibited, particularly where the buyer has provided an incorrect or misleading shipping address.
